NEW YORK — President-elect Donald Trump’s lawyers formally asked a judge Monday to throw out his hush money criminal conviction , arguing continuing the case would present unconstitutional “disruptions to the institution of the Presidency.“ In a filing made public Tuesday, Trump’s lawyers told Manhattan Judge Juan M. Merchan that dismissal is warranted because of the “overwhelming national mandate granted to him by the American people on November 5, 2024.” They also cited President Joe Biden’s recent pardon of his son, Hunter Biden, who was convicted of tax and gun charges . “President Biden asserted that his son was ‘selectively, and unfairly, prosecuted,’ and ‘treated differently,’" Trump’s legal team wrote. The Manhattan district attorney, they claimed, engaged in the type of political theater "that President Biden condemned.” Prosecutors will have until Dec. 9 to respond. They have said they will fight any efforts to dismiss the case but indicated a willingness to delay the sentencing until after Trump’s second term ends in 2029. Former President Donald Trump walks to make comments to members of the news media May 30 after a jury convicted him of felony crimes for falsifying business records in a scheme to illegally influence the 2016 election at Manhattan Criminal Court in New York. In their filing Monday, Trump's attorneys dismissed the idea of holding off sentencing until Trump is out of office as a “ridiculous suggestion.” Following Trump’s election victory last month, Merchan halted proceedings and indefinitely postponed his sentencing, previously scheduled for late November, to allow the defense and prosecution to weigh in on the future of the case. He also delayed a decision on Trump’s prior bid to dismiss the case on immunity grounds. Trump has been fighting for months to reverse his conviction on 34 counts of falsifying business records to conceal a $130,000 payment to porn actor Stormy Daniels to suppress her claim that they had sex a decade earlier. He says they did not and denies wrongdoing. Taking a swipe at Bragg and New York City, as Trump often did throughout the trial, the filing argues that dismissal would also benefit the public by giving him and “the numerous prosecutors assigned to this case a renewed opportunity to put an end to deteriorating conditions in the City and to protect its residents from violent crime.” Clearing Trump, the lawyers added, also would allow him to “to devote all of his energy to protecting the Nation.” The defense filing was signed by Trump lawyers Todd Blanche and Emil Bove, who represented Trump during the trial and since were selected by the president-elect to fill senior roles at the Justice Department. A dismissal would erase Trump’s historic conviction, sparing him the cloud of a criminal record and possible prison sentence. Trump is the first former president to be convicted of a crime and the first convicted criminal to be elected to the office. Trump takes office Jan. 20. Merchan hasn’t set a timetable for a decision. Merchan could also decide to uphold the verdict and proceed to sentencing, delay the case until Trump leaves office, wait until a federal appeals court rules on Trump’s parallel effort to get the case moved out of state court or choose some other option. Prosecutors cast the payout as part of a Trump-driven effort to keep voters from hearing salacious stories about him. Trump’s then-lawyer Michael Cohen paid Daniels. Trump later reimbursed him, and Trump’s company logged the reimbursements as legal expenses — concealing what they really were, prosecutors alleged. Trump pledged to appeal the verdict if the case is not dismissed. He and his lawyers said the payments to Cohen were properly categorized as legal expenses for legal work. A month after the verdict, the Supreme Court ruled that ex-presidents can’t be prosecuted for official acts — things they did in the course of running the country — and that prosecutors can’t cite those actions to bolster a case centered on purely personal, unofficial conduct. Trump’s lawyers cited the ruling to argue that the hush money jury got some improper evidence, such as Trump’s presidential financial disclosure form, testimony from some White House aides and social media posts made during his first term. Prosecutors disagreed and said the evidence in question was only “a sliver” of their case. If the verdict stands and the case proceeds to sentencing, Trump’s punishments would range from a fine to probation to up to four years in prison — but it’s unlikely he’d spend any time behind bars for a first-time conviction involving charges in the lowest tier of felonies. Because it is a state case, Trump would not be able to pardon himself once he returns to office. Presidential pardons apply only to federal crimes. According to Bowen Yang , Sydney Sweeney was “game” for anything during her March 2024 viral “ SNL ” hosting gig. Yang said during First We Feast’s “Hot Ones” that he at first was concerned about the “Bowen Straight” sketch needing an intimacy coordinator. The skit has Sweeney finding out Yang is straight, and then having an affair with the openly queer cast member. Yet Sweeney assured Yang that “ Euphoria ” more than prepared her for their onscreen “SNL” intimate scene. “Pitching ‘Bowen Straight’ to Sydney Sweeney was really fun,” Yang said. “I just remember being like, ‘We’re going to need an intimacy coordinator for this and it’s going to be completely up to your comfort,’ and then she was like ‘Bowen, I’m on “Euphoria,” it’s not going to be anything.’ So that was really fun and she was so game for it and she was wonderful.” Sweeney will reprise her role of Cassie for “Euphoria” Season 3. Sweeney previously told Who What Wear that she is looking forward to returning to the series after a hiatus. “I actually like [the delay] because there’s so much room for growth for both me as a person and also Cassie as a character,” Sweeney said, while teasing of the upcoming storyline, “It’s going to be very, very wild.” “Euphoria” Season 3 will now go into production in January 2025 and consist of eight episodes. Meanwhile, Sweeney is also portraying boxer Christy Martin in David Michôd’s biopic, appears in Ron Howard’s “Eden,” and will transform into Kim Novak for Colman Domingo’s directorial debut “Scandalous” about the alleged romance between Novak and Sammy Davis Jr. Sweeney told Vanity Fair that her “SNL” monologue mocking her pinup appeal was part of her political statement about the faux feminism of Hollywood. “I actually had to push for a lot of it ,” she said of the monologue. “Some people were a little nervous about it, but in real life, I’d like to say I’m a funny person. And sometimes I wish that I could address more [things with] my ‘Syd’ self, but I find that with social media there’s such a lapse in how things are communicated. It’s hard to get things across in the way that you intend to — they can be misconstrued. So being able to do it onstage in very Syd fashion, I loved it. I felt like I was taking the power back.”Rocky Mountain Advisers LLC Has $532,000 Position in Alphabet Inc. (NASDAQ:GOOGL)

Early returns positive as Timberwolves make a push to run in transition
Donte DiVincenzo grabbed a defensive rebound under the hoop off a Max Christie air ball, took a couple of hard dribbles to the side of the floor and heaved the ball forward into the frontcourt, dropping his pass over Christie’s out-stretched arms and into the lap of Julius Randle. The result was an easy flush for Randle that extended Minnesota’s lead to 12 in the second quarter of the Wolves’ win over the Lakers on Monday night at the Target Center. As Randle was putting away the score, Wolves head coach Chris Finch looked back and pointed at DiVincenzo, his way of saying, “Thank you.” Minnesota scored 20 fast-break points Monday, marking just the fourth time this season it’s hit such a total. Nine of those points came off DiVincenzo dimes. “He did a really good job of igniting our break,” Finch said. “We’ve been emphasizing trying to kick ahead more, throw the pass wide, change the angle of the floor, all that. He did a really good job of getting off of it, he and Nickeil (Alexander-Walker) connected on a couple. His decision-making was really good tonight, getting off of it quick and finding the open guy and moving it.” DiVincenzo noted there’s a distinct trust factor in basketball, and it’s prevalent in several areas within the game. If you want your teammates to consistently do something, they need to believe you’ll hold up your end of the bargain. If the Wolves want Rudy Gobert to block a shot, they need to be checking the man he is leaving on the defensive glass. If you want your teammates to run the floor hard in transition, you had better be willing to kick the ball ahead. “That’s what we did tonight, everybody,” DiVincenzo said. “And when we do that, it deflates the other team.” Minnesota has infrequently been difficult to play against this season. A piece of that equation is the Wolves often leave the easy money on the table. Fast-break points sit atop that list. According to CleaningTheGlass.com, only 13.1% of Minnesota’s offensive possessions are played in transition. That’s dead last in the NBA, even after Monday’s performance. Transition was a weak point of last year’s team, as well, but the additions of Randle and DiVincenzo were supposed to infuse some pace. But old habits die hard. The Wolves have rarely looked for opportunities to get out and run. They often don’t seem interested in the idea. It requires effort and intention. So, it’s a difficult switch to flip after it spent much of last year in the “off” position. “Just knowing you’ve got to run the floor at all times,” Wolves wing Jaden McDaniels said. “Even when you’re tired, or if the game is not going your way, just to get easy points and run the floor for your teammates.” Randle agreed that sometimes he’ll dribble up the floor and no one will be running alongside him, but added there are things he should do differently, as well. “I might get the rebound and I’m probing instead of just pushing and throwing the ball ahead and looking to flatten the defense out that way,” he said. “Or you’re probing instead of punching the gaps, or whatever it is, and you’re letting the defense catch up, so it’s just little things like that.” Minnesota’s best transition groups figure to be those that don’t include Gobert. But those lineups have been hindered by an inability to grab defensive rebounds. That has to be priority No. 1 in any instance; but once that’s secured, there needs to be more urgency to go. As Monday showed, transition offense can be a major feather in the cap of a team that sometimes struggles to score with consistency. For instance, in the first quarter, the Wolves scored just 22 points, but six came in transition. The positive sign for Minnesota is that when the issue was emphasized, players like DiVincenzo made a point to answer the call. “I think playing fast, making quick decisions, letting us use our athleticism and our quick decisions (helps),” DiVincenzo said. “I think when you slow down sometimes, guys kind of get out of rhythm. Playing fast, getting the early transition opportunities, gets everybody going, and then we can play both types of games.”NEW YORK (AP) — President-elect Donald Trump’s lawyers formally asked a judge Monday to throw out his hush money criminal conviction , arguing that continuing the case would present unconstitutional “disruptions to the institution of the Presidency.“ In a filing made public Tuesday, Trump’s lawyers told Manhattan Judge Juan M. Merchan that anything short of immediate dismissal would undermine the transition of power, as well as the “overwhelming national mandate" granted to Trump by voters last month. They also cited President Joe Biden’s recent pardon of his son, Hunter Biden, who had been convicted of tax and gun charges . “President Biden asserted that his son was ‘selectively, and unfairly, prosecuted,’ and ‘treated differently,’" Trump’s legal team wrote. He could decide to uphold the verdict and proceed to sentencing, delay the case until Trump leaves office, wait until a federal appeals court rules on Trump’s parallel effort to get the case moved out of state court or choose some other option. An outright dismissal of the New York case would further lift a legal cloud that at one point carried the prospect of derailing Trump’s political future. Last week, special counsel Jack Smith told courts that he was withdrawing both federal cases against Trump — one charging him with hoarding classified documents at his Florida estate, the other with scheming to overturn the 2020 presidential election he lost — citing longstanding Justice Department policy that shields a president from indictment while in office. The hush money case was the only one of Trump’s four criminal indictments to go to trial, resulting in a historic verdict that made him the first former president to be convicted of a crime. Prosecutors had cast the payout as part of a Trump-driven effort to keep voters from hearing salacious stories about him. Trump’s then-lawyer Michael Cohen paid Daniels. Trump later reimbursed him, and Trump’s company logged the reimbursements as legal expenses — concealing what they really were, prosecutors alleged. Trump has said the payments to Cohen were properly categorized as legal expenses for legal work.
Vardy helps Van Nistelrooy to first win with Leicester as Guehi defies the FA with religious messageNone
It was a fine first win for Ruud van Nistelrooy , and perhaps one final defeat for Julen Lopetegui. Leicester marked Van Nistelrooy’s first match in charge of the team by surging to a 3-1 win over Lopetegui's West Ham in the Premier League on Tuesday. Van Nistelrooy, the former Manchester United striker, is back in English soccer this time as a manager, with Leicester taking something of a gamble on the Dutchman after his brief and impressive spell as interim coach at United this season following Erik ten Hag's departure. He faces the tough task of keeping Leicester, one of the top candidates for relegation, in the top division. For that to happen, he’s likely to need goals from Jamie Vardy — and the 37-year-old former England international delivered immediately. Nine years after breaking Van Nistelrooy’s record for scoring in consecutive games, Vardy scored the first goal of the Dutchman’s tenure at Leicester by beating the offside trap and slotting home a finish with less than two minutes gone. Morocco midfielder Bilal El Khannouss supplied the pass for Vardy’s goal and scored himself with a low shot in the 61st minute to make it 2-0. Patson Daka added a third for Leicester in the 90th minute, before a stoppage-time consolation by West Ham substitute Niclas Füllkrug. “We are very happy with the new manager," El Khannouss said of Van Nistelrooy. “He arrived two days ago, and there’s a new dynamic in the group.” Van Nistelrooy praised the “spirit and energy” in his team. “The foundation for us going forward is everyone working their socks off, fighting for every inch and defending together,” he said. “We can look further then, and they did that in an unbelievable way.” This dismal result for West Ham came three days after its 5-2 thrashing at home by Arsenal , which piled more pressure of Lopetegui early in the former Spain and Real Madrid coach's first season with the London club. West Ham's disgruntled traveling fans chanted "You’re getting sacked in the morning” toward Lopetegui during the second half — even if his team dominated large parts of the game but only had one goal to show from 31 shots on goal. “We're very frustrated but in the same way I can say nothing about the players — they fight until the end,” Lopetegui said. "It’s not easy to explain football some days.” West Ham has lost seven of its 14 games so far and is in 14th place in the 20-team league, one spot above Leicester. Crystal Palace won for just the second time in the league this season, beating relegation rival Ipswich 1-0 to pull clear of the bottom three. Jean-Philippe Mateta scored the goal in the 59th minute. Palace’s only other league victory was against Tottenham in October. While Ipswich stayed in next-to-last place, Palace moved three points above the relegation zone. Much of the focus ahead of the game was on the teams’ captains , Sam Morsy of Ipswich and Marc Guehi of Palace, during another round when the Premier League was celebrating LGBTQ+ inclusion in its campaign to promote equality and diversity. For the second straight game, Morsy chose against wearing a rainbow armband issued to the captain of each of the 20 teams in the league. He has made the decision “due to his religious beliefs,” Ipswich says. Guehi did wear the rainbow armband but defied Football Association rules by writing a religious message on the item. The message read “Jesus loves you” — using a heart sign instead of the word “loves.” During the match against Newcastle on Saturday, Guehi wrote “I love Jesus” — and was later contacted by the FA for acting in contravention of its regulations.
