A panel of three judges on The U.S. Court of Appeals for the District of Columbia Circuit ruled unanimously that the law withstood constitutional scrutiny, rebuffing arguments from the two companies that the statute violated their rights and the rights of TikTok users in the U.S. The government has said it wants ByteDance, TikTok’s parent company, to divest its stakes. But if it doesn’t and the platform goes away, it would have a seismic impact on the lives of content creators who rely on the platform for income as well as users who use it for entertainment and connection. Here are some details on the ruling and what could happen next: In their lawsuit, TikTok and ByteDance, which is also a plaintiff in the case, had challenged the law on various fronts, arguing in part that the statute ran afoul of the First Amendment and was an unconstitutional bill of attainder that unfairly targeted the two companies. But the court sided with attorneys for the Justice Department who said that the government was attempting to address national security concerns and the way in which it chose to do so did not violate the constitution. The Justice Department has argued in court that TikTok poses a national security risk due to its connections to China. Officials say that Chinese authorities can compel ByteDance to hand over information on TikTok’s U.S. patrons or use the platform to spread, or suppress, information. However, the U.S. hasn’t publicly provided examples of that happening. The appeals court ruling, written by Judge Douglas Ginsburg, said the law was “carefully crafted to deal only with control by a foreign adversary.” The judges also rejected the claim that the statute was an unlawful bill of attainder or a taking of property in violation of the Fifth Amendment. Furthermore, Ginsburg wrote the law did not violate the First Amendment because the government is not looking to “suppress content or require a certain mix of content” on TikTok. TikTok and ByteDance are expected to appeal the case to the Supreme Court, but it’s unclear whether the court will take up the case. TikTok indicated in a statement on Friday the two companies are preparing to take their case to high court, saying the Supreme Court has “an established historical record of protecting Americans’ right to free speech.” “We expect they will do just that on this important constitutional issue,” a company spokesperson said. Alan Morrison, a professor at The George Washington University Law School, said he expects the Supreme Court to take up the case because of the novelty of the issues raised in the lawsuit. If that happens, attorneys for the two companies still have to convince the court to grant them an emergency stay that will prevent the government from enforcing the Jan. 19 divestiture deadline stipulated in the law, Morrison said. Such a move could drag out the process until the Justices make a ruling. Tiffany Cianci, a TikTok content creator who has supported the platform, said she was not shocked about the outcome of the court’s ruling on Friday because lower courts typically defer to the executive branch on these types of cases. She believes the company will have a stronger case at the Supreme Court. “I believe that the next stages are more likely to produce a victory for TikTokers and for TikTok as a whole,” Cianci said. Another wild card is President-elect Donald Trump, who tried to ban TikTok during his first term but said during the recent presidential campaign that he is now against such action. The Trump transition team has not offered details on how Trump plans to carry out his pledge to “save TikTok.” But spokeswoman Karoline Leavitt said in a statement last month that he plans to “deliver” on his campaign promises. After Trump takes office on Jan. 20th, it would fall on his Justice Department to enforce the law and punish any potential violators. Penalties would apply to any app stores that would violate a prohibition on TikTok and to internet hosting services which would be barred from supporting it. Some have speculated that Trump could ask his Justice Department to abstain from enforcing the law. But tech companies like Apple and Google, which offer TikTok’s app on their app stores, would then have to trust that the administration would not come after them for any violations. Craig Singleton, senior director of the China program at the Foundation for Defense of Democracies, said enforcement discretion _ or executive orders — can not override existing law, leaving Trump with “limited room for unilateral action.” There are other things Trump could potentially do. It’s possible he could invoke provisions of the law that allow the president to determine whether a sale or a similar transaction frees TikTok from “foreign adversary” control. Another option is to urge Congress to repeal the law. But that too would require support from congressional Republicans who have overwhelmingly supported the prospect of getting TikTok out of the hands of a Chinese company. In a statement issued Friday, Republican Rep. John Moolenaar of Michigan, chairman of the House Select Committee on China, said he was “optimistic that President Trump will facilitate an American takeover of TikTok” and allow its continued use in the United States. ByteDance has said it won’t sell TikTok. And even if it wanted to, a sale of the proprietary algorithm that powers TikTok is likely to get blocked under Chinese export controls that the country issued in 2020. That means if TikTok is sold without the algorithm, its likely that the buyer would only purchase a shell of the platform that doesn’t contain the technology that made the app a cultural powerhouse. Still, some investors, including Trump’s former Treasury Secretary Steven Mnuchin and billionaire Frank McCourt, have expressed interest in buying it. Perhaps it’s a bit unsettling around Philadelphia, then, that the grousing after a win over Carolina this weekend came from inside the locker room. Wide receivers DeVonta Smith and A.J. Brown, and even Jalen Hurts, made public their complaints about the state of the (diminishing) passing game, putting the coaching staff on notice that enough was enough and it was time to rev up the engine on a pair of 1,000-yard receivers and get the offense humming headed into the postseason. Even Sirianni conceded that yes, it was fair to raise questions about an offense that allowed Smith and Brown to combine for only eight catches and 80 yards. The problem this week? “Being on the same page,” Smith said. Smith is coming off consecutive 1,000-yard receiving seasons and has yet to break 100 in a game this season. Brown has four 100-yard games, well off last season's run when he topped 100 yards in six straight games and seven times overall. Hurts threw for just 108 yards with two TDs passing and one rushing score. Should an offense getting on the same page develop into this much of a concern for the Eagles (11-2) after 13 games? “No. I just say no," Hurts said. There are reasons the numbers are down. The easy one, of course, is that the traditionally pass-happy Eagles have leaned on Barkley and his team-record 1,623 yards to steer the offense in his first season. Hurts also shoulders his share of the blame given his propensity for holding on to the ball. He was sacked four times and missed Smith and Brown the few times he did chuck the ball deep to open receivers on long routes. The approval ends years of wrangling that launched a U.S. Justice Department investigation into why Colorado-based Liberty Media, the commercial rights holder of F1, would not approve the team initially started by Michael Andretti. Andretti in September stepped aside from leading his namesake organization, so the 11th team will be called Cadillac F1 and be run by new Andretti Global majority owners Dan Towriss and Mark Walter. The team will use Ferrari engines its first two years until GM has a Cadillac engine built for competition in time for the 2028 season. Towriss is the the CEO and president of Group 1001 and entered motorsports via Andretti's IndyCar team when he signed on financial savings platform Gainbridge as a sponsor. Grid expansion in F1 is both infrequent and often unsuccessful. Four teams were granted entries in 2010 that should have pushed the grid to 13 teams and 26 cars for the first time since 1995. One team never made it to the grid and the other three had vanished by 2017. There is only one American team on the current F1 grid — owned by California businessman Gene Haas — but it is not particularly competitive and does not field American drivers. Andretti's dream was to field a truly American team with American drivers. The fight to add this team has been going on for three-plus years, and F1 initially denied the application despite approval from F1 sanctioning body FIA. The existing 10 teams, who have no voice in the matter, also largely opposed expansion because of the dilution in prize money and the billions of dollars they've already invested in the series. Andretti in 2020 tried and failed to buy the existing Sauber team. From there, he applied for grid expansion and partnered with GM, the top-selling manufacturer in the United States. The inclusion of GM was championed by the FIA and president Mohammed Ben Sulayem, who said Michael Andretti's application was the only one of seven applicants to meet all required criteria to expand F1's current grid. "General Motors is a huge global brand and powerhouse in the OEM world and is working with impressive partners," Ben Sulayem said Monday. "I am fully supportive of the efforts made by the FIA, Formula 1, GM and the team to maintain dialogue and work towards this outcome of an agreement in principle to progress this application." Despite the FIA's acceptance of Andretti and General Motors from the start, F1 wasn't interested in Andretti — but did want GM. At one point, F1 asked GM to find another team to partner with besides Andretti. GM refused and F1 said it would revisit the Andretti application if and when Cadillac had an engine ready to compete. "Formula 1 has maintained a dialogue with General Motors, and its partners at TWG Global, regarding the viability of an entry following the commercial assessment and decision made by Formula 1 in January 2024," F1 said in a statement. "Over the course of this year, they have achieved operational milestones and made clear their commitment to brand the 11th team GM/Cadillac, and that GM will enter as an engine supplier at a later time. Formula 1 is therefore pleased to move forward with this application process." LAS VEGAS — Formula 1 on Monday at last said it will expand its grid in 2026 to make room for an American team that is partnered with General Motors. "As the pinnacle of motorsports, F1 demands boundary-pushing innovation and excellence. It's an honor for General Motors and Cadillac to join the world's premier racing series, and we're committed to competing with passion and integrity to elevate the sport for race fans around the world," GM President Mark Reuss said. "This is a global stage for us to demonstrate GM's engineering expertise and technology leadership at an entirely new level." The approval ends years of wrangling that launched a U.S. Justice Department investigation into why Colorado-based Liberty Media, the commercial rights holder of F1, would not approve the team initially started by Michael Andretti. Andretti in September stepped aside from leading his namesake organization, so the 11th team will be called Cadillac F1 and be run by new Andretti Global majority owners Dan Towriss and Mark Walter. The team will use Ferrari engines its first two years until GM has a Cadillac engine built for competition in time for the 2028 season. Towriss is the the CEO and president of Group 1001 and entered motorsports via Andretti's IndyCar team when he signed on financial savings platform Gainbridge as a sponsor. Towriss is now a major part of the motorsports scene with ownership stakes in both Spire Motorsports' NASCAR team and Wayne Taylor Racing's sports car team. Walter is the chief executive of financial services firm Guggenheim Partners and the controlling owner of both the World Series champion Los Angeles Dodgers and Premier League club Chelsea. "We're excited to partner with General Motors in bringing a dynamic presence to Formula 1," Towriss said. "Together, we're assembling a world-class team that will embody American innovation and deliver unforgettable moments to race fans around the world." Mario Andretti, the 1978 F1 world champion, will have an ambassador role with Cadillac F1. But his son, Michael, will have no official position with the organization now that he has scaled back his involvement with Andretti Global. "The Cadillac F1 Team is made up of a strong group of people that have worked tirelessly to build an American works team," Michael Andretti posted on social media. "I'm very proud of the hard work they have put in and congratulate all involved on this momentous next step. I will be cheering for you!" The approval has been in works for weeks but was held until after last weekend's Las Vegas Grand Prix to not overshadow the showcase event of the Liberty Media portfolio. Max Verstappen won his fourth consecutive championship in Saturday night's race, the third and final stop in the United States for the top motorsports series in the world. Grid expansion in F1 is both infrequent and often unsuccessful. Four teams were granted entries in 2010 that should have pushed the grid to 13 teams and 26 cars for the first time since 1995. One team never made it to the grid and the other three had vanished by 2017. There is only one American team on the current F1 grid — owned by California businessman Gene Haas — but it is not particularly competitive and does not field American drivers. Andretti's dream was to field a truly American team with American drivers. The fight to add this team has been going on for three-plus years, and F1 initially denied the application despite approval from F1 sanctioning body FIA. The existing 10 teams, who have no voice in the matter, also largely opposed expansion because of the dilution in prize money and the billions of dollars they've already invested in the series. Andretti in 2020 tried and failed to buy the existing Sauber team. From there, he applied for grid expansion and partnered with GM, the top-selling manufacturer in the United States. The inclusion of GM was championed by the FIA and president Mohammed Ben Sulayem, who said Michael Andretti's application was the only one of seven applicants to meet all required criteria to expand F1's current grid. "General Motors is a huge global brand and powerhouse in the OEM world and is working with impressive partners," Ben Sulayem said Monday. "I am fully supportive of the efforts made by the FIA, Formula 1, GM and the team to maintain dialogue and work towards this outcome of an agreement in principle to progress this application." Despite the FIA's acceptance of Andretti and General Motors from the start, F1 wasn't interested in Andretti — but did want GM. At one point, F1 asked GM to find another team to partner with besides Andretti. GM refused and F1 said it would revisit the Andretti application if and when Cadillac had an engine ready to compete. "Formula 1 has maintained a dialogue with General Motors, and its partners at TWG Global, regarding the viability of an entry following the commercial assessment and decision made by Formula 1 in January 2024," F1 said in a statement. "Over the course of this year, they have achieved operational milestones and made clear their commitment to brand the 11th team GM/Cadillac, and that GM will enter as an engine supplier at a later time. Formula 1 is therefore pleased to move forward with this application process." Yet another major shift in the debate over grid expansion occurred earlier this month with the announced resignation of Liberty Media CEO Greg Maffei, who was largely believed to be one of the biggest opponents of the Andretti entry. "With Formula 1's continued growth plans in the US, we have always believed that welcoming an impressive US brand like GM/Cadillac to the grid and GM as a future power unit supplier could bring additional value and interest to the sport," Maffei said. "We credit the leadership of General Motors and their partners with significant progress in their readiness to enter Formula 1." The Eagle Valley girls volleyball team had four players named to the Western Slope all-league team for the 2024 season. Aspen Misch and Taylor Hooper earned first-team recognition and Zakia Shreeve and Riley Weatherred were named to the second team. Misch was also invited to play in the Colorado Coaches of Girls Sports All-State game on Nov. 24. The Devils placed second in the league with an 8-4 record, finishing behind only Battle Mountain (12-0) in the Western Slope standings. They were ousted in the regional tournament on Nov. 11 after falling to Palmer Ridge 3-1 and Green Mountain 3-0. The Huskies later faced Palmer Ridge in the state tournament, but were swept by the defending state champions. “We challenged ourselves to be our best at regionals and I believe we did that,” head coach Mike Garvey stated. “We came out ready to play and stole the first set 25-14. “We competed all night, but just were not the better team.” Coming off an undefeated league record in 2022 and a 2023 season which saw a senior-heavy squad take the Devils to their first state tournament since 2016 , Garvey said before this year began that his current team would need to believe in themselves and embrace the opportunities at hand. In addition to the competitiveness displayed at regionals, the coach said he witnessed growth throughout the season. “We learned many things,” he stated. “The team always responded well when we made mistakes and had to go to the next level in both practice and matches.” Misch had the most blocks on the team (66) and finished tops in hitting percentage (0.264). Hooper — who also was an all-league honorable mention athlete as a sophomore in 2022 — was second in kills (151). Shreeve led the team in kills (163) and aces (61) while Weatherred was tops in assists (289) and second in digs (184) and aces (37).
