Why Rosen Law: We encourage investors to select qualified counsel with a track record of success in leadership roles. Many of these firms do not actually litigate securities class actions, but are merely middlemen that refer clients or partner with law firms that actually litigate cases. Be wise in selecting counsel. The Rosen Law Firm represents investors throughout the globe, concentrating its practice in securities class actions and shareholder derivative litigation. Rosen Law Firm achieved the largest ever securities class action settlement against a Chinese Company at the time. Rosen Law Firm was Ranked No. 1 by ISS Securities Class Action Services for number of securities class action settlements in 2017. The firm has been ranked in the top 4 each year since 2013 and has recovered hundreds of millions of dollars for investors. In 2019 alone the firm secured over $438 million for investors. Details of the case: According to the lawsuit, during the Class Period, defendants made false and/or misleading statements and/or failed to disclose that: (1) Dentsply targeted low-income people who did not have access to good oral hygiene education, a dentist, or dental insurance, which often meant patients signing up for Byte, a direct-to-consumer ("DTC") aligner solution, had underlying dental issues that would have made them ineligible for treatment; (2) the push for Byte growth and sales commissions caused sales employees to sell to contraindicated patients; (3) as a result of the above, the Byte patient onboarding workflow did not provide adequate assurance that contraindicated patients did not enter treatment; (4) before and during the Class Period, reports of Byte patient injuries were pouring in; (5) Dentsply knew that its Byte aligners were causing severe patient injuries for years but did little to investigate those injuries or notify the U.S. Food and Drug Administration ("FDA"); (6) Dentsply had no systems in place to notify the FDA of these injuries, which Dentsply is required to do within 30 days of learning of a problem; (7) the FDA had received a sharp uptick in reports of serious injuries from Byte patients; (8) as a result of the above, Dentsply materially overstated the goodwill value of Byte; and (9) as a result of the above, defendants' positive statements about Dentsply's business, operations, and prospects were materially false and misleading and/or lacked a reasonable basis at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages. ENGLEWOOD, Colo. (AP) — Losses to the Chargers and Bengals with a playoff berth on the line show Sean Payton made a miscalculation when he agreed to flex the Denver Broncos' Week 16 game to a Thursday night. The NFL needed the Broncos' approval to replace the Cincinnati-Cleveland game with the Broncos-Chargers game because Denver had already played on a Thursday night on the road. He eagerly agreed to the switch, figuring the team's fanbase always travels well to SoFi Stadium in Los Angeles and the Broncos would be the more rested team at Cincinnati. But after an emotional comeback win over the Colts, the Broncos (9-7) lost to the Chargers in part because Payton got away from the run even though it helped them score touchdowns on their first three drives — and he had written “Run It!!” in marker on top of his play sheet. And they lost to the Bengals 30-24 in overtime on Saturday after Payton decided against going for 2 and the win when Marvin Mims Jr. hauled in a highlight-reel touchdown grab between two defenders with 8 seconds left in regulation. “We knew a tie for us was just as beneficial as a win,” Payton explained. “We felt like we had the momentum at that point.” Holding up two fingers, rookie QB Bo Nix lobbied for the 2-point try to no avail. “We discussed it all. We had plenty of time, plenty of time, plenty of time,” Payton said. "And the decision we made was the right one.” Well ... An extra point assured Joe Burrow would get the ball back, and the Broncos hadn't forced a single punt all game, something Payton acknowledged afterward that he wasn't aware of, and they hadn't stopped the Bengals since twice holding them on fourth down in the first half. They finally forced a punt in overtime, but the Broncos went three-and-out, something they did again after Bengals kicker Cade York doinked a 33-yard field-goal attempt off the left upright on Cincinnati's second possession. With the Bengals out of timeouts, all the Broncos needed was a first down and they'd be playoff-bound for the first time since 2015, but Bo Nix misfired to tight end Adam Trautman on third-and-long, so the Broncos punted and Burrow led the Bengals (8-8) on their game-winning touchdown drive. “I thought we could move the ball in overtime,” Nix said, “but we didn't.” The Broncos could render all of it moot with a win in Week 18 against Kansas City with the Chiefs (15-1) expected to rely heavily on backups as they rest up for the playoffs as the AFC's top seed. But Denver's defense has been dismal since November, giving up the most yards in the league, and another letdown against the Chiefs would give the Broncos their biggest collapse in two decades. “This is what we do it for — meaningful games here,” Payton said. "I think it’s important that you embrace it, and it is exciting. There’s nothing worse than playing games in the last part of the season where there’s nothing at stake. So I think it’s something we’ll all be excited about.” What’s working Denver's pass rush. The Broncos sacked Burrow seven times, giving them a league-high 58 for the season. Zach Allen had a career-best 3 1/2 of them and Dondrea Tillman's sack gives the Broncos six players without at least five sacks this season. What needs help Riley Moss led the Broncos with 14 tackles but he had a tough return to action after missing a month with a sprained MCL. Burrow targeted him over and over, including on the game-winning touchdown throw to Tee Higgins, who caught three TD passes. “Riley could have been healthy for the last eight weeks. Whoever’s opposite Pat, they’re going to go that direction, right?" Payton said. (Higgins) is a good player. A real good player. It wasn’t anything that we didn’t expect. In other words, that happens when you’re teammates with Pat.” Stock up WR Marvin Mims Jr. had a breakout performance with eight catches for 103 yards and two fourth-quarter touchdowns, a 51-yarder and the 25-yard catch on fourth down in the closing seconds while sandwiched between two veteran defenders. Stock down Denver's defense. Even with Moss back, which allowed DC Vance Joseph to go back to relying more on man coverage, the Broncos defense continued to struggle since the calendar turned to December. Injuries The Broncos came out healthy although superstar CB Patrick Surtain II was limping on the game's final snaps. Key number 5 — Number of NFL rookie QBs to throw for at least 3,000 yards and 25 touchdowns with Nix joining Justin Herbert, Baker Mayfield, Russell Wilson and Peyton Manning. What’s next It's all or nothing next week when a win over the Chiefs would send Denver to the playoffs. ___ AP NFL: https://apnews.com/hub/NFL Arnie Stapleton, The Associated PressDonald Trump nominates investment banker Warren Stephens to be US ambassador to UK
After Juan Soto's megadeal, could MLB see a $1 billion contract? Probably not soonThe King and the Prime Minister have paid tribute to Jimmy Carter following the former US president’s death on Sunday aged 100. In a message to the American people, the King expressed “great sadness” at the news of Mr Carter’s death, describing him as “a committed public servant” who “devoted his life to promoting peace and human rights”. He added: “His dedication and humility served as an inspiration to many, and I remember with great fondness his visit to the United Kingdom in 1977. “My thoughts and prayers are with President Carter’s family and the American people at this time.” Mr Carter, a former peanut farmer, served one term in the White House between 1977 and 1981 and spent his post-presidency years as a global humanitarian, winning the Nobel Peace Prize in 2002. Sir Keir Starmer said Mr Carter had “lived his values in the service of others to the very end” through “decades of selfless public service”. Praising a “lifelong dedication to peace” that saw him win the Nobel Peace Prize in 2002, Sir Keir added: “Motivated by his strong faith and values, President Carter redefined the post-presidency with a remarkable commitment to social justice and human rights at home and abroad.” Tributes to Mr Carter followed the announcement of his death by his family on Sunday, more than a year after he decided to enter hospice care. His son, Chip Carter, said: “My father was a hero, not only to me but to everyone who believes in peace, human rights, and unselfish love.” Very sorry to hear of President Carter’s passing. I pay tribute to his decades of selfless public service. My thoughts are with his family and friends at this time. pic.twitter.com/IaKmZcteb1 — Keir Starmer (@Keir_Starmer) December 29, 2024 US President Joe Biden, one of the first elected politicians to endorse Mr Carter’s bid for the presidency in 1976, said the world had “lost an extraordinary leader, statesman and humanitarian”. He said: “Over six decades, we had the honour of calling Jimmy Carter a dear friend. But, what’s extraordinary about Jimmy Carter, though, is that millions of people throughout America and the world who never met him thought of him as a dear friend as well. “With his compassion and moral clarity, he worked to eradicate disease, forge peace, advance civil rights and human rights, promote free and fair elections, house the homeless, and always advocate for the least among us.” Vice President Kamala Harris said Mr Carter “reminded our nation and the world that there is strength in decency and compassion”. “His life and legacy continue to inspire me — and will inspire generations to come,” she said. “Our world is a better place because of President Carter.” Other UK politicians also paid tribute to Mr Carter. Liberal Democrat leader Sir Ed Davey said he was “an inspiration” who “led a truly remarkable life dedicated to public service with a genuine care for people”. Scottish First Minister John Swinney described the former president as “a good, decent, honest man who strove for peace in all that he did”, while Welsh First Minister said he was “a remarkable man” and “a humanitarian and scholar”. Former prime minister Sir Tony Blair said Mr Carter’s “life was a testament to public service”. He added: “I always had the greatest respect for him, his spirit and his dedication. He fundamentally cared and consistently toiled to help those in need.” Gordon Brown, another former prime minister, said it was a “privilege” to have known Mr Carter, who “will be mourned, not just in America, but in every continent where human rights are valued”. Mr Carter is expected to receive a state funeral featuring public observances in Atlanta, Georgia, and Washington DC before being buried in his hometown of Plains, Georgia. A moderate democrat born in Plains in October 1924, Mr Carter’s political career took him from the Georgia state senate to the state governorship and, finally, the White House, where he took office as 39th president in the wake of the Watergate scandal and the Vietnam War. His presidency saw economic disruption amid volatile oil prices, along with social tensions at home and challenges abroad including the Iranian revolution that sparked a 444-day hostage crisis at the US embassy in Tehran. But he also brokered the Camp David Accords between Egypt and Israel, which led to a peace treaty between the two countries in 1979. After his defeat in the 1980 presidential election, he worked more than four decades leading The Carter Centre, which he and his late wife Rosalynn co-founded in 1982 to “wage peace, fight disease, and build hope”. Under his leadership, the Carter Center virtually eliminated Guinea Worm disease, which has gone from affecting 3.5 million people in Africa and Asia in 1986 to just 14 in 2023. Mrs Carter, who died last year aged 96, had played a more active role in her husband’s presidency than previous first ladies, with Mr Carter saying she had been “my equal partner in everything I ever accomplished”. Earlier this year, on his 100th birthday, Mr Carter received a private congratulatory message from the King, expressing admiration for his life of public service We do not moderate comments, but we expect readers to adhere to certain rules in the interests of open and accountable debate.

San Francisco 49ers running back Christian McCaffrey and top backup Jordan Mason are being placed on injured reserve. McCaffrey left the snowy field in Buffalo on Sunday night after a 5-yard gain that was preceded by him heading to the sideline in apparent pain at the end of an 18-yard run. McCaffrey was diagnosed with a posterior cruciate ligament injury in his right knee and did not play in the second half. The 49ers also lost Jordan Mason, who emerged in a starting role with McCaffrey out the first two months of the season, to an ankle injury. Head coach Kyle Shanahan said Monday that Mason has a high-ankle sprain, which typically requires a recovery window of 4-6 weeks. Those moves push rookie Isaac Guerendo into the RB1 spot. He scored the team's only touchdown at Buffalo. The IR slots in San Francisco are manned by multiple starters, including wide receiver Brandon Aiyuk, linebacker Dre Greenlaw, defensive tackle Javon Hargrave and safety Talanoa Hufanga. Mason had a team-leading 789 rushing yards and scored three touchdowns. Being placed on IR means he's not eligible to play until the regular-season finale at Arizona. McCaffrey had 53 yards on seven carries on Sunday night and caught two passes for 14 yards before exiting. He was playing in just his fourth game of the season after missing the first eight because of Achilles tendinitis. McCaffrey was the NFL Offensive Player of the Year last season, when he led the league with 2,023 yards from scrimmage: a league-leading 1,459 rushing yards and 14 touchdowns plus 67 catches for 564 yards and seven scores. McCaffrey hasn't scored a touchdown in his four appearances this season. He has rushed for 202 yards on 50 carries and caught 15 passes for 146 yards. "It was frustrating," Shanahan said after the game. "He had a great week of practice and I could feel his urgency and stuff and thought he came out great, looking really good, and it looked like he just got his shoestring there. ... I hurt for him, and tough for our team not having him." The 49ers (5-7) played without defensive end Nick Bosa (oblique) and left tackle Trent Williams (ankle) in the 35-10 loss. San Francisco has lost three in a row heading into next Sunday's game against the Chicago Bears (4-8) in Santa Clara, Calif. San Francisco resides two games behind the NFC West-leading Seattle Seahawks (7-5) with five games remaining on the schedule. Seattle and San Francisco split their season series. --Field Level MediaStop me if you heard this one, but the Aaron Rodgers era in New York did not go as planned. The Jets currently sit at a paltry 3-10 record with four games to go and then the team overhaul can begin. The Jets will be hiring a new general manager and a new head coach just as soon as they are able to start conducting interviews after the last game of the regular season and they will need to be aggressive. Once the GM and coach are set, assuming Woody Johnson doesn’t scare off all the potential candidates , they can get to work together on the roster. While I believe that the Jets have a lot of good, young talent worth holding on to, they will need to continue to build out their roster as there will likely be significant roster overhaul as contracts expire, and the new regime looks to put their mark on the team. The Jets will look to once again build through the NFL Draft no matter who the GM and head coach is. Currently, the Jets hold the number seven overall pick with four games left to go. In AtoZ Sports latest mock draft by AJ Schulte , the Jets take a weapon on the outside for the new quarterback in Missouri wide receiver Luther Burden III: Aaron Rodgers is all but gone in the new year and the Jets can save $35 million in cap space by cutting his buddies Davante Adams and Allen Lazard. That would leave the team stuck with Garrett Wilson and Xavier Gipson as their top two options, with little behind them. No quarterback is going to succeed in those conditions. Add a real playmaker to this offense in Luther Burden III . I like that Schulte didn’t have the Jets taking the third best QB off the board in a panic pick. The Jets better really like QB if they are going to take him top-10 because the franchise has missed far too often on the position. Taking a wide receiver does make a lot of sense especially considering Adams and Lazard are both likely on new teams in 2025. They were brought in because of their connections to Aaron Rodgers, but Rodgers will also likely be donning a new uniform in 2025 as the Jets will try and distance themselves from the failure of his tenure. That would just leaves Garrett Wilson, but I wouldn’t be surprised if they start to worry about life after him as well. So, a young playmaking wide receiver does make sense there. The Missouri star is a big-play threat down the field and a creator with the ball in his hands, which would give whoever the new offensive coordinator is a versatile chess piece that he can deploy from anywhere in the formation. At some point in the draft, preferably in the first three rounds, the Jets will need some sort of quarterback of the future. I wouldn’t be surprised if they don’t take one in the top 10 considering the lack of talent at the position this season. I honestly wouldn’t mind if the Jets took Michigan defensive lineman Mason Graham there either. Graham has no holes in his game, and the Jets interior defensive line consists of Quinnen Williams and a bunch of dudes. Owning the middle of the defense could go a long way to being competitive in 2025. There is a long time to go between now and April’s NFL Draft, but what else do Jets fans have to do but dream of next season. His son, Chip Carter, said: “My father was a hero, not only to me but to everyone who believes in peace, human rights, and unselfish love.” US President Joe Biden, one of the first elected politicians to endorse Mr Carter’s bid for the presidency in 1976, said the world had “lost an extraordinary leader, statesman and humanitarian”. He said: “Over six decades, we had the honour of calling Jimmy Carter a dear friend. But, what’s extraordinary about Jimmy Carter, though, is that millions of people throughout America and the world who never met him thought of him as a dear friend as well. “With his compassion and moral clarity, he worked to eradicate disease, forge peace, advance civil rights and human rights, promote free and fair elections, house the homeless, and always advocate for the least among us.” Speaking to reporters from his family vacation in the US Virgin Islands, Mr Biden said his predecessor represented “the most fundamental human values we can never let slip away” and the world had lost a “remarkable leader”. Asked if there were any lessons President-elect Donald Trump could learn from Mr Carter, he answered: “Decency, decency, decency”. Vice President Kamala Harris said Mr Carter “reminded our nation and the world that there is strength in decency and compassion”. Earlier this year, on his 100th birthday, Mr Carter received a private congratulatory message from the King, expressing admiration for his life of public serviceISU men come back a better team following an 84-70 loss to storied UCLA
49ers RBs Christian McCaffrey, Jordan Mason placed on IRNEW YORK (AP) — U.S. consumers who were “tricked” into purchases they didn't want from Fortnite maker Epic Games are now starting to receive refund checks, the Federal Trade Commission said this week. Back in 2022, Epic agreed to pay a total of $520 million to settle complaints revolving around children’s privacy and payment methods on its popular Fortnite game. The FTC alleged the video game giant used deceptive online design tactics to trick Fortnite players, including children, into making unintended purchases “based on the press of a single button." Consumers could be charged while doing something as simple as attempting the wake the game from sleep mode, for example, or by pressing a nearby button when trying to preview an item, the agency said. The FTC also accused Epic of blocking some users who disputed the charges from accessing the content they purchased. Beyond a $275 million fine related to collecting personal information on players under the age of 13, the settlement included $245 million in customer refunds. Now, the first batch of those refunds are being sent out. On Monday, the FTC announced it was sending over 629,00 payments to eligible customers who submitted claims. About half of those refunds are PayPal payments, which should be redeemed within 30 days, and the rest are checks, which should be cashed within 90 days. The average refund is about $114, the FTC noted. This first round of payments amounts to a total of more than $72 million, according to the agency — leaving about $173 million left to be distributed. Impacted consumers can still apply for a refund online . People who are eligible for these payouts include Fortnite players who were charged in-game currency for items they didn’t want or saw their account locked after complaining to a credit card company about wrongful charges between January 2017 and September 2022 — as well as parents whose child made charges on their credit cards without their knowledge from January 2018 through November 2018. You can learn more about applying for a refund on the FTC's website . The deadline for submitting a claim is January 10, 2025. At the time the settlement was announced in December 2022, Epic said it accepted the agreement because it wanted "to be at the forefront of consumer protection and provide the best experience for our players.” The Cary, North Carolina-based added that it was already rolling out changes “to ensure our ecosystem meets the expectations of our players and regulators, which we hope will be a helpful guide for others in our industry.”
ALTOONA, Pa. (AP) — The man accused of killing UnitedHealthcare’s CEO struggled with deputies and shouted while being led into court Tuesday as new details emerged about his possible motivation behind the ambush. In his first public words since a five-day search ended with his arrest at a McDonald's in Pennsylvania, Luigi Nicholas Mangione emerged from a patrol car shouting about an “insult to the intelligence of the American people” while deputies pushed him inside a courthouse. The 26-year-old Ivy League graduate from a prominent Maryland real estate family is fighting attempts to extradite him to New York so that he can face a murder charge in the Manhattan killing of Brian Thompson , who led the United States’ largest medical insurance company. A law enforcement bulletin obtained by The Associated Press said that at the time of his arrest, Mangione was carrying a handwritten document expressing anger with what he called “parasitic” health insurance companies and a disdain for corporate greed and power. He wrote that the U.S. has the most expensive health care system in the world and that profits of major corporations continue to rise while “our life expectancy” does not, according to the bulletin. In social media posts, Mangione called “Unabomber” Ted Kaczynski — who carried out a series of bombings while railing against modern society and technology — a “political revolutionary,” according to the police bulletin. Mangione remained jailed in Pennsylvania, where he was initially charged with possession of an unlicensed firearm, forgery and providing false identification to police. Manhattan prosecutors were beginning to take steps to bring Mangione to New York, but at a brief hearing Tuesday, defense lawyer Thomas Dickey said his client will not waive extradition and instead wants a hearing on the issue. Mangione was denied bail after prosecutors said he was too dangerous to be released. He mostly stared straight ahead at the hearing, occasionally looking at papers, rocking in his chair or looking back at the gallery. At one point, he began to speak to respond to the court discussion but was quieted by his lawyer. “You can’t rush to judgment in this case or any case,” Dickey said afterward. “He’s presumed innocent. Let’s not forget that.” Mangione was arrested in Altoona, Pennsylvania, about 230 miles (about 370 kilometers) west of New York City, after a McDonald’s customer recognized him and notified an employee, authorities said. Images of Mangione released Tuesday by Pennsylvania State Police showed him pulling down his mask in the corner of the McDonald's while holding what appeared to be hash browns and wearing a winter jacket and beanie. In another photo from a holding cell, he stood unsmiling with rumpled hair. New York police officials have said Mangione was carrying a gun like the one used to kill Thompson and the same fake ID the shooter had used to check into a New York hostel, along with a passport and other fraudulent IDs. A law enforcement official who wasn’t authorized to discuss the investigation publicly and spoke with The Associated Press on condition of anonymity said a three-page, handwritten document found with Mangione included a line in which he claimed to have acted alone. “To the Feds, I’ll keep this short, because I do respect what you do for our country. To save you a lengthy investigation, I state plainly that I wasn’t working with anyone,” the document said, according to the official. It also said, “I do apologize for any strife or traumas but it had to be done. Frankly, these parasites simply had it coming.” Thompson, 50, was killed last Wednesday as he walked alone to a Manhattan hotel for an investor conference. From surveillance video, New York investigators determined the shooter quickly fled the city, likely by bus. Mangione was born into a life of country clubs and privilege. His grandfather was a self-made real estate developer and philanthropist. Valedictorian at his elite Baltimore prep school, he went on to earn undergraduate and graduate degrees in computer science in 2020 from the University of Pennsylvania, a spokesperson said. “Our family is shocked and devastated by Luigi’s arrest,” Mangione’s family said in a statement posted on social media late Monday by his cousin, Maryland Del. Nino Mangione. “We offer our prayers to the family of Brian Thompson and we ask people to pray for all involved.” From January to June 2022, Luigi Mangione lived at Surfbreak, a “co-living” space at the edge of touristy Waikiki in Honolulu. Like other residents of the shared penthouse catering to remote workers, Mangione underwent a background check, said Josiah Ryan, a spokesperson for owner and founder R.J. Martin. “Luigi was just widely considered to be a great guy. There were no complaints,” Ryan said. "There was no sign that might point to these alleged crimes they’re saying he committed.” At Surfbreak, Martin learned Mangione had severe back pain from childhood that interfered with many aspects of his life, from surfing to romance, Ryan said. Mangione left Surfbreak to get surgery on the mainland, Ryan said, then later returned to Honolulu and rented an apartment. Martin stopped hearing from Mangione six months to a year ago. ___ Scolforo reported from Altoona and Hollidaysburg, Pennsylvania. Small’s layup with under 2 minutes left in OT gave West Virginia a 79-75 lead. After a Gonzaga miss, Sencire Harris hit two free throws to make it a six-point lead. With 27.1 seconds left, Harris made a steal and scored on a dunk for an eight-point lead, putting the game out of reach. Amani Hansberry scored a career-high 19 points and Toby Okani added 10 for West Virginia (3-2). Braden Huff scored 19 points and Khalif Battle 16 for Gonzaga (5-1). Takeaways Gonzaga showed its depth, outscoring the West Virginia bench 30-2. West Virginia’s only loss was by 24 points at Pitt, but the rebuild under Darian DeVries is showing promise. Key moment Gonzaga turned it over at midcourt late in regulation when Tucker DeVries poked it away from Nolan Hickman and raced the other way before getting fouled. DeVries made two free throws with 5.9 seconds left to tie it at 71-all. Battle inbounded the ball and got it back, but lost control on a drive as time expired. Key stats The shorter Mountaineers outrebounded Gonzaga 42-36 and shot 50% in the second half, battling the Zags to a draw in the paint. Nembhard had 12 assists and just one turnover in 43 minutes, but was 1 of 10 from the field. Up next Gonzaga faces No. 14 Indiana on Thursday on the consolation side of the bracket.
